California has reached a deal between the trial lawyers and the california Medical Association to raise the payouts for non-economic med mal payments.  This is in lieu of a November fight for votes.  The new payout limit for pain and suffering will rise to $350,000 on January 1.  This will go up over ten years to a max of $750,000.  If death is the end result then the cap will start at $500,000 and go to $1,000,000 over the ten year period.  After that it will be adjusted by a 2% COS increase.  Also the plaintiff would be eligible for two payouts instead of only one now.  One from a provider and one from an facility.
