Indiana v Hasenour
Arrested

Dr. Derrick Hanenhour, The assistant CMO at Windrose Health Network in Franklin was arrested after allegedly purchasing 30 Oxy tablets from a patient that he originally prescribed the meds to.  

Virginia v Allingham
Sentenced

Dr. David Allingham of Oakton was sentenced to 13 years in prison for conspiring to distribute narcotics, maintaining drug premises and false statements.  The Addiction Medicine physician was previously convicted of writing prescriptions for narcotics without a good faith exam.  

Florida v Green
Arrested

Juanette Green LPN of Miami was arrested fr aggravated manslaughter of an elderly or disabled adult.  She allegedly disconnected her mother's respirator in the hospital allowing her to die.  She wanted her mother to go in peace.  

Kentucky v Marsiti
Arrested

Dr. Bradford Marsiti, of Baltimore but working at the University of Louisville, was arrested for possession of 68 child porn images.  

Maryland v Maroof
Guilty

Dr. Anissa Maroof of Potomac plead guilty to unlawful distribution of narcotics.  The addiction psychiatrist was prescribing various drugs to patients in West Virginia who were then selling them on the street.  She told the patients how to split filling their prescriptions between different pharmacies.

Arizona v Nguyen
Indicted

Dr. Dung Nguyen of Tucson was indicted for sexual assault.  He allegedly assaulted patients during medical exams.  Six women said he touched their breasts and on accused him of sexual intercourse.  

New Hampshire v Soucy
Guilty

Dr. Robert Soucy of Columbia plead guilty of illegally prescribing narcotics.  

US v Ali, Malik
Guilty

Dr. Mohd Makik, a psychiatrist who owns Psych Care consultants, LLC of Missouri, plead guilty of submitting false claims to fed med for services performed while he was out of the country.  Dr. Asim Ali worked for Dr. Malik at did the servicwes including those which he not allowed to perform or did not do face to face exams.  

Maine v Norris
Sentenced

Dr. Meridith Norris of Kennebunk was convicted on multiple counts of illegally distributing narcotics.  Her sentence, for whatever reason, was three years probation and a fine of $7000.  Seems like she should have been tried on manslaughter and receive many years in prison.

US v Whitman
Arrested

Kevin Whitman of Irondequoit, New Tork, was arrested for taking anothers identity and writing prescriptions narcotics.  He is not a physician.        Top

FTC v Welsh, Carson Anderson and Stowe
Settlement

The conglomerate agreed to limit its involvement with US Anesthesia Partners and to tell the FTC about all future acquisitions and investments in anesthesia and other hospital based physician practices.  This settle the suit against them but continues the suit against USAP for buying up nearly every large anesthesia practice in Texas to create a singe dominant provider.  

US v Pinellas Eye Care ( Gulfcoast Eye Care)
Settlement

The northern Florida medical practice agreed to pay $615,000 to settle allegations that they falsely billed transcranial doppler ultrasounds that were provided through an illegal kickback scheme.  This is a qui tam case.

US v Snowball, Pain Management LLC
Settlement

The Stamford, Connecticut, medical practice owned by Dr. Halina Snowball agreed to pay $427,129 to settle allegations that they submitted false payments and received overpayments from fed med.  

US v Zamora-Quezada
Sentenced

Dr. Jorge Zamora-Quezada, a rheumatologist was sentenced to 10 years in prison.  He was convicted of misdiagnosing and treating patients with rheumatoid arthritis when in fact they had no such disease.

US v Assertio Therapeutics Inc.
Settlement

The Lake Forest pharmaceutical companmy agreed to pay $3.6 million for causing false claims to be filed to fed med for their pain med Lazanda for individuals who did not have breakthrough cancer pain.  That was the only indication for the drug to be paid by fed med .  This is a qui tam case by two sales reps who will spit $657,000.

US v Britton-Harr

Patrick Britton-Herr of Charleston, South Carolina, was indicted for allegedly doing medically unnecessary tests on nursing home patients and billing fed med.  He was also indicted for allegedly scamming 100 rich people into purchasing aircraft and then using the money for his own enjoyment and not purchasing the planes.

US v Tassin
Guilty

Dr. Robert Tassin of Slidell, Louisiana, plead guilty to healthcare fraud.  He worked for telemed companies and wrote phony prescriptions for unnecessary cancer genetic tests and then falsified the records to show they were necessary.        Top

Niyimbona v Providence Sacred Heart Hospital

The twelve year olod was a patient at the hospital for months due to repeated attempts to end her life.  She finally did it by jumping off the hospital parking garage.  The suit alleges that the hospital did not follow its own policies and procedures.  

Powell v Palazzolo, Ungarino, Morgan III
Verdict

The 28 year old got a stomach virus followed by sepsis and shock.  She was treated at Phoebe Putney Hospital  by Drs. James Palazzolo, Thomas Ungarino and Joe Morgan III with vasopressors at a dose 2.5 times the usual maximum dose in violation of the initial physicians order and was continued at that amount for over 40 hours.  She lost both legs due to gangrene.  The jury came back with a $70 million verdict.  There will be no appeal since there was a pre-trial agreement as to damages.

US v Ogbonnaya

Christiana Ogbonnaya was a nurse at the Houstan VA Hospital.  One of her patients James Duplechain died during her shift.  He was found unresponsive at 4:40 AM and died soon after.  The feds state that the RN lied about how often she saw the patient and falsified the electronic medical record.  

Messer v Cole
Filed

The patient is suing the physician for a bad outcome from cosmetic surgery.  She alleges that he botched the surgery and that the state medical board is looking into the surgeon.  Cole is being sued by others as well for the same thing.  All the patients have the same attorney.  How is that possible?  Could the attorney have gone shopping for patients after having one potential legitimate case?  Nah!  No ethical attorney would do that!

Dunne v Carle Clinic Methodist Hospital

The father of a 32 year old male sued the Peoria, Illinois, hospital for negligence after the son left the hospital and later killed himself.  He was admitted for psychiatric care and was awaiting a bed when he left.          Top

Porter v Dartmouth Health
Verdict

A jury awarded Dr. Misty Porter $1.125 million for having her disability rights violated after she was fired allegedly due to two lengthily medical leaves of absence.  Her attorneys are now seeking more than that for attorney fees.  The judge will decide that later this year.

Doe v El Camino Hospital
Filed

An unnamed nurse is suing the Mountain View, California, hospital for ignoring her report of sexual assault by her manager.  She alleges that at an off campus party attended by about 40 El Camino employees she was followed into the bathroom, groped and pressured to perform oral sex.  Since it was an off campus event the hospital refused to do anything not even interview at accused.          Top
