Physicians v United Healthcare
2nd Circuit

The 2nd Circuit refused to overturn the preliminary injunction against the insurer prohibiting them from cutting their Medicare Advantage physicians in Connecticut.  It gave the physicians 30 days to affected physicians to file for arbitration to contest their removal.  This could get very expensive for the insurer as each case is different.        Top

HIPAA

Unity Health Plan of Wisconsin services about 140,000 people and about 1/3 recently received letters telling them their PHI has been compromised.  The info is missing from the U of Wisconsin School of Pharmacy where it was part of a benefits program evaluation.        Top

US v Kam
Sentenced

Dr. Hoi Yat Kam was sentenced to 12 months and one day for scamming the feds.  He, after his release is to serve 3 years of supervision and repay $2.2 million in restitution.  

US v DeHann
indicted

Dr. Charles DeHann of Belvidere, Illinois, was indicted for health care fraud.  He was accused of billing for house calls not medically necessary.        Top

Notre Dame v Sebelius
7th Circuit

Notre Dame University is fighting the contraception mandate of Obamacare.  The feds will mount a defense based on the issue that the facts are not the same as Little Sisters which received a stay from the Supreme Count last month.  Notre Dame states the facts are the same.        Top

McIntire v Mich. Inst of Urology
Mich Ct App

In a case that is hard to fathom Dr. McIntire was according to the report a terribly  disruptive physician who was rightfully dismissed from the urology practice.  She sued claiming racial discrimination and of course lost.  Why would she sue?  Why would an attorney take the case to the court of appeals?  What a waste of resources.        Top
