US v Mohiuddin
Sentenced

Syed Mohiuddin, the former president of United Memorial Medical Center in Houston, Texas, has been sentenced to 21 months in prison and must pay $11 million in restitution.  He plead guilty last year of falsifying records in order to obtain a $8 million loan.  In a related case the hospital was ordered to pay over $2 million to settle allegations that they overbilled fed med.

US v McQueen
Guilty

Jaclyn McQueen RN of Dedham, Massachusetts, plead guilty to removing narcotics from syringes and using it on herself.  She worked in a rehab center.

US v Cooper, Alshafey
Sentenced

Dr. Scott Cooper of West Bloomfield was sentenced to five years in prison and pharmacist Zaman Alahafey got 3 years.  Cooper  prescribed narcotics to patients with out a medical reason.  This included getting narcotics to a prisoner for three years without any contact with the prisoner.  Alahafey illegally got cough syrup for several dollars a bottle and sold it for up to $3500 per bottle.

Florida v Ramos
Arrested

Maria Ramos RN was arrested for allegedly stealing credit cards from patients and using them to purchase goods for herself. 

Florida v Nieves
Arrested

 Groennou Nieves RN was found on the floor with an IV in her leg attached to propofol.  She also tested positive for cocaine.

Minnesota v Broker
Guilty

Cambie Broker RN plead guilty to stealing from a hospice clinic almost 20,000 oxycodone along with fentanyl patches.

Fraud

US v Carmeci, Asante System
Settlement

Medford, Oregon, Asante and Dr. Charles Carmeci, a cardiothoracic physician, agreed to pay $430,000 to settle allegations that they fraudulently billed fed med for procedures the surgeon did not perform.  This was a qui tam suit by another physician.

 US v Ali, Malik
Indicted

Drs. Asim Ali and Mohd Malik worked together in st Louis.  They were indicted of illegally storing and using Ketamine.  Malik was allowed but Ali was not.  Ali had no DEA license but was giving ketamine to patients without adequate oversight.  Malik was allowing the practice and allowing Ali to bill under his Medicare number.

US v RDx Bioscience, Leykin
Settlement

The Kenilworth, New Jersey lab and its New York owner CEO Eric Leykin agreed to pay $10,315,023 to resolve allegations of false claims and an additional $3 million to New Jersey.  They were alleged to pay kickbacks for testing and then bill for those tests.

US v Silver Lake Hospital
Settlement

The long term care hospital in Newark, New Jersey agreed to pay $30.6 million to settle allegations that they lied regarding their cost outlier payments and paid big bucks illegally to their investors.  The investors will pay into the fund as well.  

Consumers v Endeavor Health
Settlement

The Chicago health system that came about with the merger of Northshore gobbling up Highland Park Hospital 16 years ago.  The will pay the princely sum of $55 million in a class action suit.  This has nothing to do with the prior FTC action regarding the merger.

Texas v Shoulders
Convicted

A jury convicted Ray Shoulders PA for giving amnionic fluid to patients for pain relief and then billing fed med for the unapproved shots.

US v New York Presbyterian Hospital
Settlement

The hospital agreed to pay just over $800,000 to settle allegations that they billed for radiology exams that were read late or not at all.

Fields v Woodhyll Hospital, NYC Health and Hospital System
Filed

The family of thirty year old Christine Fields has filed a med mal suit against the hospital where she died post-op C-Section.  The coroner stated she bled to death.  The suit claims her blood vessels were injured in the surgery and not repaired.  This is another black woman injured during childbirth.

Querales v Nunnally, Freeman and Owens
Filed

The husband of Maria Querales had dental surgery in 2022.  During the surgery she was given Fentanyl by anesthesiologist Dr. Jerry Teague and bottomed out.  she is now unresponsive and requires a feeding tube.  Teague died two weeks later from cancer.  

Overfield v El Dorado County
Filed

Everyone knows that the California Penal system has the worst medical care in the country but this is a new low even for them.  A 38 year old male with HIV died from a secondary infection after not receiving his not receiving his anti HIV meds while he was incarcerated.  

Nunez v Summerlin Hospital Medical; Center
Filed

The patient states she had a C-Section at the hospital many years ago and no other surgery.  She states she has complained of intermittent abdominal pain in the intervening years.  She recently had surgery to remove a retained foreign body, a lap sponge.  She is suing.  The question will be the statute of limitations.

McKiverson v Bayer
Verdict

The patient got non-Hodgkin's Lymphoma and used Roundup prior to getting the cancer.  The jury awarded $250 million in compensatory damages and an additional $2 Billion in punis.  This happened in the notorious state of Pennsylvania.

Bramblett v Legacy
Filed

 Joshua Bramblett RN was the lead ED nurse at the hospital who states in his suit that he was fired for speaking up for safety concerns for his staff.  The hospital did not deny the charges but said they would respond in court.
